NO LIFETIME EMPLOYMENT—YET NO FULL PENSION REFUND

How many people understand this contradiction?
Many foreign nationals in Japan work under fixed-term contracts and time-limited residence statuses. Companies do not guarantee long-term employment; in many cases, contracts are terminated before the fifth year. If a person is recruited at the same position for the fifth year, the position automatically turns permanent. Yet the government requires these workers to join the pension system in the name of securing their retirement.
But that may not be what they want. Those who do not intend to settle permanently in Japan may understandably prefer a higher take-home salary now—to educate their children, support their families back home, or buy a house—rather than contribute to a pension they may never receive.
The bigger problem is that foreign workers do not receive a full refund of their contributions when they leave Japan.
The Lump-sum Withdrawal Payment is generally calculated using a maximum of five years of contributions. For example, even if someone contributed for seven and a half years, the payment is calculated on only five years. Once the payment is received, however, the entire seven-and-a-half-year contribution record is erased.
Employees and employers each pay roughly half of the Employees’ Pension Insurance premium. However, the withdrawal payment does not return the total amount contributed by both sides. Only the employee's contribution is returned. Furthermore, 20.42% is withheld as tax when the payment is made. Although all or part of this tax may later be reclaimed through a tax representative, appointing one may involve additional fees.
Even when Japan has a social security agreement with a worker’s home country, this does not mean that 100% of the Japanese contributions are transferred to that country’s pension account. These agreements mainly prevent double enrollment and allow contribution periods in both countries to be combined. Japan currently has agreements in force with 24 countries, but those with the UK, South Korea, China, and Italy do not allow contribution periods to be combined.
The government may argue that pensions are social insurance—not personal savings—and therefore contributions and benefits need not be equal.
But is the system truly fair? Employers do not guarantee long-term employment, and the government does not guarantee permanent residence. Nevertheless, foreign workers must join the pension system, while only part of their contribution history may be reflected in the withdrawal payment.
At minimum, Japan should consider:
Abolishing the five-year calculation limit
Introducing fairer payments based on the full contribution period
Concluding social security agreements with more countries
Providing multilingual assistance so people can receive Japanese pensions from abroad
Allowing short-term residents to choose between the pension system and an alternative scheme
If Japan needs foreign workers, it must treat their contributions fairly and transparently.
Mandatory participation that disregards workers’ wishes, combined with an inadequate withdrawal system—is this truly fair for an advanced country?
Surely, we can develop a more effective and equitable system.

この矛盾を、どれだけの人が理解しているだろうか。
日本で働く外国人の多くは、有期雇用契約や期限付きの在留資格の下で働いている。企業は長期雇用を保証しない。5年目の契約継続がなく首切りは基本(同ポジションで4年以上勤務すると自動的に終身雇用に切り替わりため)。それにもかかわらず、国は「老後の生活保障」を理由に、外国人労働者にも年金制度への加入を義務づけている。
しかし、本人の希望は必ずしもそこにない。日本に永住する予定のない人であれば、将来受け取れるか分からない年金よりも、今の手取りを増やし、子どもの教育や母国の家族の生活、住宅取得などに使いたいと考えるのは自然なこと。
さらに大きな問題は、日本を離れる外国人に、納めた年金保険料がそのまま返されるわけではないことだ。
外国人が帰国後に請求できる「脱退一時金」は、支給額の計算対象が原則として最長5年分に制限されている。例えば、日本の年金に7年6か月加入していても、受給額は最大5年分で計算される一方、一時金を受け取れば、7年6か月すべての加入記録が年金上なくなる。
厚生年金の保険料は、本人と企業がほぼ半分ずつ負担している。しかし、脱退一時金は「本人と企業が納めた保険料を全額返還する制度」ではない。本人の部分が返還対象で、しかも、支給時には20.42%が源泉徴収される。ただし、この税金については、納税管理人を通じて還付申告を行えば、全部または一部が戻る可能性はあるが、管理人への手数料は発生してしまう。
また、社会保障協定を結んでいる国であっても、日本で納めた保険料が母国の年金口座へ「100%返金」されるわけではない。協定の主な目的は、二重加入の防止と、両国の年金加入期間の通算である。日本は現在24か国と協定を発効させているが、英国、韓国、中国、イタリアとの協定には加入期間の通算制度がない。
制度上、これは「貯金」ではなく、世代全体で支え合う社会保険である。そのため、納付額と返還額が一致しなくても当然というのは政府側のスタンスであろう。
しかし、企業が長期雇用を保証せず、国も永住を保証しない外国人労働者に対し、年金加入だけを一律に義務づけ、帰国時には納付実績の一部しか一時金の計算に反映しない。この仕組みが本当に公平だと言えるのだろうか。
制度を維持するために外国人労働者の意思を無視するのではなく、少なくとも次の選択肢を検討すべきだ。
脱退一時金の5年上限を撤廃する
加入期間に応じた、より公平な返還制度を設ける
社会保障協定をより多くの国と締結する
帰国後も日本の年金を確実に受給できる多言語支援を整える
短期滞在者には、年金加入か代替制度かを選べる仕組みを検討する
外国人を労働力として必要とするのであれば、その人たちが納めた保険料も、公平かつ透明に扱わなければならない。
労働者の意思を無視した強制加入と、不十分な返還制度。これは本当に、先進国としてフェアな仕組みなのだろうか。もっと効果的な方法と仕組みを考えようじゃありませんか。
